DG of Badilag Obtains Doctorate in Law

Director General (DG) of the Indonesia’s Religious Courts, Purwosusilo, now holds a doctorate in law after successfully defending his dissertation at Bandung Islamic University (Unisba) on Monday (4/2/2014). The DG’s full name is now Dr. H. Purwosusilo, S.H., M.H.

His dissertation is entitled “The Proportionality Principle in the Contract for Procurement of Goods/Services According to Presidential Decree No. 54/2010 to Achieve Good Governance”.

“Considering his subjects scores, dissertation grade, and the score of this doctoral exam, the university declares that Mister Purwosusilo passed with very satisfactory,” said the chairman of the open session, Dr. H. Mercy Ceha, who was accompanied by a number of professors.

In the doctoral examination which lasted for 1.5 hours, Purwosusilo smartly answered all questions put forward by the examining professors.

A quite striking question came from Dr. H. M. Faiz Mufidi, S.H., M.H. “You come from the Religious Court but you don’t discuss the issue of marriage and the like. Instead, you researched the issue of procurement. Why is that?” he asked.

Responding to the question, Purwosusilo admitted that not everyone can understand his reasons for choosing the procurement of goods/services as his research object. Given that he is a judge from the Religious Court.

Purwosusilo then expressed three reasons why he chose the theme of procurement of goods/service rather than other themes that are more consistent with the authority of the Religious Court.

"First, there is a moral message in order my colleagues to be more careful in carrying out procurement of goods / services," he said.

"Secondly, I want the Religious Courts to have experts in various number of fields; marriage, philosophy, procurement, and others,” he added.

The third reason, which is the most fundamental, is that the procurement of goods/services carried out conventionally was not able to solve the problem. Although laws and regulations have been revised several times, budget leakage due to the procurement of goods/services is still happening.

A number of top officials from the Supreme Courts were seen attending the DG’s doctoral examination, such as Secretary of the Supreme Court, justices, chairpersons of echelon I institutions, chief judges, and others.
