BP4 a potential mediation agency: Chief Justice

The Supreme Court fully supports programs of BP4 (Agency for Counseling, Fostering and Perpetuation of Marriage) especially those pertaining to mediation of cases handled by Religious courts. Chief Justice, Dr. Harifin A. Tumpa, SH, MH, expressed this firm back up when giving an audience to National Executive Board of BP4 Wednesday (9/9/09) at his office in Jakarta.

Responding to BP4’s intention to be a mediation agency that can legally produce mediators, Harifin maintaines his support while adding that BP4 has to meet the requirements stipulated by Supreme Court Regulation (PERMA) No. 1/2008 on Mediation Procedures in Courts.

“It’s a good opportunity for BP4 (to become a mediation agency),” Chief Justice said.

Meanwhile General Chairman of BP4, Drs. H. Taufiq, SH, MH said BP4 had long been active in fostering peaceful marriages. BP4 also provided advocacy and mediation for marital disputes.

“BP4 is well experienced and qualified on mediation matters. What BP4 needs now is a modern method of mediation so as to touch the hearts of disputing parties to reconcile,” Taufiq added.

Vice Chief Justice for Judicial Affairs, Abdul Kadir Mappong, expressed his agreement. He said BP4 fit in becoming a mediation agency whose mediators practicing at Religious Courts.

“Successful programs of BP4 will lighten the tasks of judges at Religious Courts because they are now also mediators,” Deputy Chief Justice for Religious Courts Affairs, Andi Syamsu Alam, said.

Ahmad Kamil, Vice Chief Justice for Non-Judicial Affairs advised that BP4 could play a more active role in providing advocacy for people intending to bring their cases to Religious Courts.

“Capable members of BP4, for example can give assistance in making divorce application (claim/petition).”

However, Ahmad Kamil stressed BP4’s advocacy and mediation had not to burden justice seekers, especially on advocacy and mediation fees.
