Judgment publication enhances work performance, says Director General

Director General of Badilag, Wahyu Widiana, said Wednesday (24/11) that judgment publication on the websites is a form of judicial transparency and will trigger the enhancement of court officers’ performance. He also believes that judgment publication will automatically make the proceedings and case handling procedures in the courts more effective, efficient and timely.

Wahyu delivered his statement when addressing the participants of Technical Guidance for PTA’s judgment publication held by badilag in Jogjakarta from 24 – 26 November. This program involved leaderships and information officers of PTAs (High Religious Courts) throughout Java.

This program, Wahyu explained, was a strategic response to the enactment of Law No. 14/2008 on the Opennes of Public Information that will take effect April 2010.

“Starting from April 2010, if we (Religious Courts) as public institutions do not provide and publish the verdicts, we will be imposed sanctions.”

In addition, judgment publication has now had stronger legitimacy with the issuance of Law No. 3/2009, Law No. 48/2009 and Law No. 50.2009. Therefore, Wahyu hopes that courts decisions, at least PTAs’ verdicts, can all be published on the webs.

Domino Effect

”According to the Law, judgments shall be published within 14 days after the final hearing. And this cannot be done if the prior proceedings and procedures of case handling run ineffectively. That’s why this judgment publication has a domino effect that requires qualified Human Resources, quality of discipline, productivity and orderly court administration,” Director General said.

We should be proud of Religious Courts being the pioneer of judgment publication in Indonesia, Wahyu went on. Badilag launched PTA’s judgment publication on International website asianlii on February 12, 2008. However, the number of judgments published on asianlii is relatively smaller than the number of finalized cases. Besides that, the consistency of judgment delivery from High Religious Courts to Badilag still needs improving.

“In 2007 and 2008, Indonesian High Religious Courts finalized 3611 cases, but the number of judgments published on the web during the two years is only 1460 cases, leaving the rest 2151 cases remain unpublished,” Wahyu said.

Through this technical guidance program, according to Asep Nursobah, 1701 judgments have been garnered. “Although not all of the collected verdicts can be uploaded during this program, but Badilag IT Team will finish publishing them in Jakarta,” he said. (asnoer/cho)
