Vice Chief Justice for Non Judicial Affairs earns his doctorate satisfactorily

Vice Chief Justice for Non-judicial Affairs Hon. Ahmad Kamil has successfully earned a Doctorate from postgraduate program of Gadjah Mada University (UGM) Jogjakarta. He was even granted a graduate with satisfactory level by his dissertation examiners in the open promotion of doctoral examination of postgraduate program on Friday (5/3/10).
Ahmad Kamil successfully retained his dissertation entitled “Kebebasan Hakim Dalam Persfektif Filsafat Kebebasan Franz Magnis Suseno; Relevansinya Bagi Pembinaan Hakim Indonesia” focusing on philosophy and law.
The examiners team consisted of Prof. Dr. R. Soejadi, SH (Promotor), Prof. Dr. Lasiyo, MA, MM (Co-Promotor), Prof. Dr. Edhi Martono, MSc (Chairman) with members of examiners: Prof. Dr. Kaelan, Prof. Dr. Abdul Ghofur Anshori, SH, Prof. Dr. Djoko Soerjo, MA, Prof. Dr. Syamsulhadi, MA, Dr. Mohammad Hatta, SH, MH, and Dr. Joko Siswanto.
.Judge’s Independence
Ahmad Kamil based his dissertation on his anxiety over some court decisions (verdicts) that often received criticism, resistance and were non-executable.
“Is it because the judge’s freedom in considering such decisions is no longer derived from the values of the Pancasila philosophy, as a way of life of the nation? So that the judges judgments are far from living legal values and sense of justice?” he asked.
The principle of judge’s independence, Ahmad Kamil said, should be understood as the freedom that is built on the values of nobility and greatness of judge’s dignity.
Indonesian judges should in advance have in-depth understanding of the Pancasila philosophy before being stuck to debate legal trends (school) of natural law, legal positivism, utilitarianism, school of history, sociological jurisprudence and legal realism.
By employing a system of philosophical thinking of Pancasila, judges’ verdicts will then contain philosophical justice, in addition to other elements of legal justice, social justice and moral justice, he concluded his dissertation.
Responding to this doctoral achievement, Director General of Badilag Wahyu Widiana expressed his feelings of happiness and pride. On behalf of himself and all Religious Courts community, Wahyu conveyed congratulations to the Vice Chief Justice who began his career as a judge at Religious Court. (vic)
