Badilag Successfully Held Fit and Proper Test

Vice-Chief Justice for Non-Judicial Affairs and Deputy Chief Justice for Development Affairs are examining the participants of fit and proper test

Fit and proper test to determine the Chief Justice of the Class I Religious Court at certain cities was successfully held by Badilag on Wednesday (11/09/2011). There were 31 participants tested for chief justices  in 13 Religious Courts.

"This is the first fit and proper test we hold. Alhamdulillah, it can run smoothly," Director General of Badilag, Wahyu Widiana said.

Fit and proper test that was held in Alila Hotel, Jakarta, was originally planned to be followed by 33 participants, but two of the them were absent because they conducted pilgrimage to Mecca.

The 31 participants consisted of 12 deputy chief justice of class IA RC, 13 Chief Justices of class IB RC and 6 deputy Chief Justice of Class IB RC. They aged under 52 years old.

The Religious Courts included in the 13 Class IA RC located at certain cities are Medan RC, Palembang RC, Central Jakarta RC, South Jakarta RC, North Jakarta RC, East JakartaRC, West Jakarta RC, Bandung RC, Semarang RC, Yogyakarta RC, Surabaya RC, Mataram RC, and Makassar RC.

 

Eight leading people acted as the examiner. They were divided into three groups. The first group consisted of The Honorable Ahmad Kamil (Vice Chief Justice for Non-Judicial Affairs), the Honorable Widayatmo Sastro Hardjono (Deputy Chief Justice for the Development Affairs), and The Honorable Prof. Abdul Manan (The Supreme Court Justice).

The second group consisted of The Honorable Andi Syamsu Alam (Deputy Chief Justice for Religious Court Affairs), The Honorable Hatta Ali (Deputy Chief Justice for Supervisory Affairs), and The Honorable Habiburrahman (Supreme Court Justices). Meanwhile, the third group consisted of Wahyu Widiana (Director General of Badilag) and Kadi Sastrowiyono (practitioner).

The first and second group focused on personality affairs (vision, mission, and conception), the management or leadership and guidance of judge’s code of conduct. In addition, they also focused on the technically legal mastery and judicial administration.

Meanwhile, as the third examiners, DG of Badilag, Wahyu Widiana emphasized on information technology (IT) and Kadi Sastrowiyono on Arabic mastery (Bahts al-Kutub).

Even information and technology was not included in the Decree of The Supreme Court Chief Justice number 140/KMA/SK/VII/2010 dated July 23rd, 2010, as the subject of the test, the DG of Badilag included it.

“Our goal is not to examine whether the participants were able or not to operate the IT devices. What we do is a kind of mapping. We would like to know the commitment and what have they done to utilize the IT in their working unit.” The DG explained.

Thus, the DG went on, IT has a close relationship with management and administration of the judiciary and that why is included in fit and proper test.

The result of fit and proper test will be announced openly at badilag’s website.

Should the result be announced based on the the rank or not, the committee did not decide yet.

For the time being, the assessment result is still kept by the examiner. And each examiner will deliver their assessment to decide who would be proper to be the chief justice of first class religious court at the certain cities.
