Mediation is a part of the court’s duties

Even the success rate of divorce mediation in the religious court is low, mediation remains needed. That is one of the points stated by Director General of Badilag, Wahyu Widiana in his speech while opening the mediation workshop conducted by Badilag in cooperation with AIPJ (Australia Indonesia Partnership for Justice) and Family Court of Australia (FCoA) at Mercure Hotel, Ancol (09/17/2012).

“Apart from being the part of court’s duties, mediation also offers solution for the justice seekers.” He insisted in front of 30 (thirty) participants of the workshop that will be held for 3 (three) days from September 17th to 19, 2012.

. Among the solutions can be seen in the cumulative cases of divorce, matrimonial properties, and child custody.

“Even the main cases can not be mediated, the derivative ones, like matrimonial property and child custody are successfully mediated. And these much help the process of cases settlement for the justice seekers.” He explained.

With such success, the Director General of Badilag hoped the process of mediation was not conducted in a formalistic way to fulfill the need of the law.

“There are two things that must be considered to develop mediation, namely the substance of mediation like the assesment of a success mediation and the commitment to provide the services to the mediated justice seekers, women, children and people with disabilities.” He explained more details.


The statement of the Director General of Badilag was responded positively by the Program Director of AIPJ, Nicola Colbran. In her speech, she expected that the workshop will benefit the participants in developing mediation in Indonesia. According to her, the ultimate goal of mediation was not only to reconcile the spouses, but the mediator had to consider the post divorce issues. The mediator was expected not only to be able mediate the divorce, but also be able to mediate the matrimonial property and child custody issues.

Mediation remains our serious concern

According to Wahyu Widiana, seven years ago in his initial office as the Director General, Directorate General of Badilag held a comparison study to Australia. There were two focuses of the study at the time, namely the development of information technology and mediation. Even finally the progress of information technology is more advanced than the mediation, it does not mean that mediation has not been neglected. So far, mediation has been assumed as the field of judicial technic, that made Badilag difficult to develop mediation.

In the future, we hope that we do not only develop the process and technic of mediation, but also the lay out of a comfort mediation room for the justice seekers. Such rooms as were developed in some countries which provided a qualified room for children and mediation. [Mohammad Noor]
