Case Trend in First Level and Cassation Level

The number of cases in first instance, appeal and cassation level shows different characteristic. According to Deputy Chief Justice for Religious Court Affairs, Andi Syamsu Alam, there is a unique trend in total cases received by courts in each year.
“Total cases received by courts of first level tended to increase in 2011, meanwhile the number decreased in cassation level’, he said.
Date collected by the Directorate General of the Religious Courts shows that there is an increase of cases to 120 % in ten years.

In last ten years, the total cases received by Appeal Courts increases to 50%. This number is smaller than total cases received by first instance courts. The number of cases in cassation level does not reach 1% compared to cases in first instance courts.

This trend is probably caused by some reasons. First, justice seekers are very satisfied with decisions made by first instance courts. Therefore, they do not need to bring their cases to higher courts. Second, it is assumed that justice seekers do not know the procedures on how to bring their cases to appeal courts. And third, justice seekers know the procedures but they do not bring their cases to appeal courts due to cost and transportation problems.
