The Number of the Religious Courts Increased Time to Time
Jakarta l Badilag.net
In their history, the Religious Courts had faced crucial challenge relating to their jurisdiction in handling cases. However, the number of them has been increasing from one period to period.
For example, during Law No. 1 of 1974 on Marriage was issued, the number of the Religious Courts was 258. At that time, there were only 8 appeal courts.
The number increased to 268 courts which included 10 appeal courts. It was 100 years after their establishment.
The Religious Courts finally had their own Law in 1989. The House of Representative issued Law No. 7 of 1989 on the Religious Courts. At that time, the number of the Religious Courts were 352 consisting of 327 first instance courts and 25 appeal courts.
.Before 2004, the Religious Courts were under the Ministry of Religious Affairs. After Indonesian Supreme Court adopted “one roof system”, all courts including Religious Courts were under the Supreme Court.
The House of Representative issued new Law No. 3 of 2006. This Law amended the Law No. 7 of 1989 on the Religious Courts. The number of the Religious Courts increased to 372 consisting 343 first instance courts and 29 appeal courts.
The Religious Courts celebrated their 130 years of anniversary in 2012. The number are now 388 courts consisting 359 first instance courts and 29 appeal courts.
