Legal Discussion on Decision Quality Improvement

The Directorate General of the Religious Courts (Badilag) held a legal discussion, Tuesday (30/04/2013). It was the first discussion which focused on decision of courts. Badilag plans to hold such program three times in this year.

It was attended by around 50 participants involving some chiefs of appeal courts and judges of first instance courts. M. Yahya Harahap, S.H, ex Deputy Chief Justice for Criminal Case, was the speaker on the discussion.

Andi Syamsu Alam, the Chief Chamber of Religious Court stated that the discussion was very interesting. It is urgent that judges improve the quality of their decisions.

He also said that decisions of the Religious Courts are pretty good in comparison with two or three decades.

“We found that not all decisions are bad. But, we realize that some of them must be improved,” he said.

According to Andi Syamsu Alam, the weakness of Religious Courts’ decision is on reasoning. It was commonly found in many decisions.

 

He said that Yahya Harahap is the right person invited to discuss on how to improve the quality of decisions. Yahya Harahap wrote many books on decision and formal law. In addition, he had experiences as justice in the Supreme Court for around 19 years.

“Honestly, I learnt about law of evident from him. He explained about it in detail and specific,” he said.

Purwosusilo, the Director General of the Religious Courts, explained that the discussion was held in support of other programs of Badilag.

“We found critics from some people who stated that our decisions are not good. Therefore, we prioritize on this matter,” he said.

Purwosusilo also said that the result of the discussion will be published on a digital magazine. More judges will be informed on the discussion.
