Draft of KHAES Has Been Introduced

The Directorate General of Religious Courts introduced the draft of the compilation for sharia economic procedural law in Pekanbaru, May 7 – 9, 2013. The Directorate aimed to collect abundant suggestion from judges.
The Chairman of the Working Team for Religious Civil, Prof. Dr. H. Abdul Manan, S.H., S.Ip., M. Hum said that the Supreme Court has a team for making the draft and it has been initiated since two years ago.
The team was created by a Decree Letter of the Chief Justie No. 151/KMA/SK/VIII/2010 dated August 16, 2010.
“This draft consists of 12 chapters and 268 articles,” Prof Abdul Manan said.

The draft is mainly referred from procedural law applied in General Courts and Religious Courts as well. Besides, it got other sources from sharia economic procedural law applied in Arab counties involving Egypt, Sudan, Syria, and Iran.
Prof. Abdul Manan also suggested judges to learn more on sharia economic matters. It is important to be prepared to examine and to settle sharia economic cased filed to the Religious Courts.
The Religious Courts have jurisdiction in examining cases of family law matters and sharia economic.
