Badilag (Directorat General of the Religious Courts at the Supreme Court) plans to contest best court decisions of the religious courts all over Indonesia. This effort is one manifestation of the institution’s seriousness in improving the quality of court judgments.
DG Badilag Purwosusilo just recently said that Badilag is drafting the Terms of Reference (ToR) for the competition. He hoped the draft would be finalized early September next month.
“We’ll discuss and finalize the draft at the coordination meeting between Badilag and leadership of High Religious Courts throughout Indonesia in Jakarta next month,” he added.
.In general, DG Badilag explains that the judgments which will be competed are those from first instance courts which are already final and legally binding (inkracht).
“The judgments nominated for the contest must be ‘complex’ decisions such as inheritance, joint-marital property, and syariah economy cases,” Purwosusilo said.
There will be three criteria for the assessment. They are case administration, proceedings administration and legal considerations as well as the order of the judgments.
This contest is planned to take place for three months, from September to November this year.
