Malaysian Terengganu Shari'a Judicial Officials Visit Badilag

The Director General of Badilag received Malaysian Terengganu Sharia Judicial Officials visit yesterday (14/7) at his office in Jakarta. The Chief Sharia judge of Terengganu, Y.A.A. Dato Ismail Bin Yahya said the objective of this visit was to share information on fostering and developing religious judicature and to discuss the most recent legal issues related to Moslem's life.

The fourteen Malaysian delegates representing almost all elements of Terengganu's judicial power were warmly welcomed by Wahyu Widiana, The Director General, and Indonesian Supreme Court Justice/Chief of workgroup on religious civil cases, Prof. Dr. H. Abdul Manan, SH, S.IP along with Badilag's officials from 2nd and 3rd echelons. The delegates were led by the Director of Religious and Information Affairs of Terengganu, Ustadz Khazan bin Che Mat and the Chief Sharia Judge of Terengganu, Y.A.A. Dato Ismail bin Yahya.

“The existence of Indonesian Religious Courts under one roof system along with other courts is interesting to analyze since in Malaysian legal system, our sharia courts never structurally meet with other courts, whereas in some competencies particularly in family law system, Malaysia and Indonesia have many things in common,” Y.A.A. Dato Ismail bin Yahya told the attendants.


Wahyu Widiana presented the existence of the religious court in Indoesian legal system by showing the organizational structure of the Supreme Court of Indonesia before and after one-roof system. In addition, Wahyu illustrated constellation of religious courts led by woman judges. Again, the chief judge of Terengganu showed his interest on the issue of woman judge leadership, a system that Malaysia does not allow. Meanwhile, Indonesian Supreme Court Justice/Chief of workgroup on religious civil cases gave an in-depth explanation on the competence of Indonesian religious courts as stipulated by Law No. 3/2006.

In the question-answer session, one of the delegates, Tuan Wan Mohd. Zakri bin Wan Mohd, commented on the polygamy permission of the religious court competence. “Malaysian Sharia Court also has such competence, but Malaysian legal system does not recognize the alternative and cumulative requirements as stated by Indonesian law,” he said.
The visit lasted for about two hours and ended with exchanging souvenirs and posing for pictures together. (asep nursobah/cho)
