The Religious Courts Get an International Publicity

The recent achievements of the Religious Courts are now well known by international public. They are published in the International Journal of Court Administration (IJCA), in 7th edition, December 2011. This journal belongs to International Association for Court Administration (IACA) which is located in Louisville, Kentucky, America.

The journal publishes a summary of the book titled Courting Reform: Indonesia’s Islamic Courts and Justice for the Poor which is the work of Cate Sumner and Prof Tim Lindsey. The book was published in Australia and launched in Sydney, December 2010.

The Interest of IACA to the Religious Courts

In his email sent to Wahyu Widiana (the Director General of the Religious Courts), Markus B Zimmer, Advisory Council Chair of IACA stated that he was very interested in the progress made by the Religious Courts.

Markus Zimmer who had wide working experiences in 25 countries knew more on the Religious Courts after he read a booklet written by Cate Sumner and Prof Tim.

Badilag Plans to Celebrate 130 Years of the Religious Court Anniversary

The Directorate General of the Religious Courts (Badilag) is planning to celebrate 130 years of the Religious Court anniversary. The celebration will be held at the end of June 2012.

Some important events will be also conducted during the celebration including tennis tournament, national seminar, awarding, book launching, etc.

According to the Director General of the Religious Courts, Wahyu Widiana, this celebration is urgently important. One main reason is to let people know about the recent development and achievement made by the Religious Courts.

“We have to hold the celebration in order to inform public on what we have achieved,” he said.

Wahyu Widiana also said that the celebration would be very beneficial to encourage all apparatus of the Religious Courts to enhance their performance of work in the future.

“We want all stakeholders such as practitioners of Shari banking, NGOs, academician and others being well informed with our recent progresses,” he said.

Some books which will be launched in the celebration are the book of 130 Years of the Religious Courts, of the Prominent Figures of the Religious Courts, of the International Cooperation, etc.

Badilag will plan to publish a quarterly magazine. It will inform public on some salient programs and achievements.

Religious Court Only Has 273 Certified Judge-Mediators

Until the end of 2011, Religious Court only has 273 judges who have been certified mediators.  211 of them are judge-mediators at the first instance courts and the remaining 62 high judges at the appellate court.

Director of the Development of Religious Court Judicial Staff, Drs. Purwosusilo, SH., MH at his office Wednesday afternoon (04/01) said that all the mediators have attended special training on procedures of mediation conducted by the Board of Research, Development, and Training of Law and Judicature of the Supreme Court since 2009 until 2011.

According to him, the number of mediators are still very less when compared to the amount of the religious court units and cases handled. Based on personnels data of Directorate General of Badilag, the number of judges of Religious Courts throughout Indonesia currently are 3,687 judges, and it means the number of certified judge- mediators only 7.40% of all.

Legal Aid Post Will Increase in 2012

The number of the Religious Courts providing legal aid post (Posbakum) will increase in 2012. There will be 20 new Religious Courts. Therefore, the number will be 66.

The Director General of the Religious Courts, Wahyu Widiana officially stated about that in Depok, Wednesday night (27/12/2012).

According to him, the Directorate General of the Religious Courts (Badilag) has planned to add 23 new Religious Courts. But, unfortunately, the budget cannot cover all.

“We suspend 3 new Religious Courts for the next year,” he said.


The 20 new Religious Courts which will provide legal aid post in 2012 are MSy of Takengon (Aceh), RC of Binjai, RC of Lubuk Pakam (North Sumatera), RC of Bukit Tinggi (West Sumatera), RC of  Tanjung Pinang (Riau), RC of Bangko (Jambi), RC of Baturaja (South Sumatera), RC of Metro (Lampung), RC of Sumber dan RC of Tasikmalaya (West Java), RC of Serang (Banten), RC of Tuban, RC of Lamongan, RC of Sidoarjo (East Java), RC of Sampit (Central Kalimantan), RC of Balikpapan (East Kalimantan), RC of Mamuju (West Sulawesi), RC of Selong (West Nusa Tenggara), RC of Ruteng (East Nusa Tenggara), dan RC of Manokwari (West Papua).

Legal Aid Post as one important program of justice for all will play an important role to enhance the reputation and the credibility of the Supreme Court of Indonesia in international forum.

“Program of justice for all is an urgent indicator that our institution maintain and protect the rights of poor and marginalized people,” he said.

Wahyu Widiana stated that international people are now focusing on this matter including gender and disability.

He also explained on the new Law no. 16 of 2011. Actually, the Law will take into in 2012 but, because the Government Regulation has not existed yet, the Law will be applied in 2013.

This new Law stipulates that legal aid will conducted by the Ministry of Law and Human Rights.

Based on trilateral meeting consisting of the Supreme Court, the Ministry of Law and Human Rights and the State Planning Agency held in December 1, 2011, it was agreed that the Supreme Court can conduct the legal aid post in 2011.

Three New Chiefs of High Religious Court were Inaugurated

Three New Chiefs of High Religious Court were inaugurated and sworn in by the Chief Justice, The Hon. Harifin A Tumpa in Kusuma Atmadja Room, Supreme Court building on Friday (12/30/2011).

The three chiefs were Drs. H. Rodlin Afif, SH (as the chief of Palangkaraya HRC), Drs. H. M. Djufri Ahmad, SH., MH., (as the chief of Kendari HRC), and Drs. H. Bahruddin Muhammad, SH., MH (as the chief of North Maluku HRC).

The positions occupied by the new officials were vacant before. And on December 7th, 2011 the leaders of the Supreme Court and the Promotion Team agreed to perform the transfer and promotion of High Religious Court Chiefs, deputies and high judges. And the three officials were among of those promoted.

Before being promoted as the Chief of Palangkaraya HRC, Drs. H. Rodlin Afif, SH. was the Deputy Chief of Banjarmasin HRC. And now his previous position is officiated by Drs. H. Ismail Ibrahim, SH., MH.
