Wahyu Widiana was Invited to Share Some Experiences in Malaysia

Director General of the Religious Courts, Wahyu Widiana agreed with the idea of Mr. Haji Abdul Malik bin Haji Kassim, who represented the Deputy Minister that sharing experiences among judges and staff from Indonesia, Malaysia and Thailand was very important. It was aimed to enhance the quality of each judicial system.

According to Wahyu Widiana, it would be very beneficial due to many similarities the three countries had irrespective of some differences. 
Wahyu Widiana was invited to attend one day seminar held by Sharia Judiciary Office of Pulau Pinang State in cooperation with International Islamic Technology College of Pulau Pinang, Friday (24/2/2012). This seminar was attended by around 50 participants from Malaysia, Indonesia, and Thailand.

Besides Wahyu Widiana, Chiefs of High Religious Courts from Medan and Padang, High Judges from Medan and some chiefs of first instance court in Medan also attended the seminar.

The main purpose of this seminar was to understand judicial system among countries and to discuss the recent issues related to law. It was also aimed to develop cooperation among countries.

Legal Aid after the Issuance of the Law No. 16 of 2011

According to the Law No. 16 of 2011, legal aid is organized by the Ministry of Law and Human Rights. However, this Law recognizes a transition period in which legal aid conducted in some institutions including the Supreme Court, the Indonesian Police, and the Attorney continues to run in 2012 in those institutions.

Agency for National Legal Development (BPHN) is finalizing some technical regulations on how to implement the legal aid in accordance with the Law No. 16 of 2011. BPHN had created a special team involving many parties.

The World Bank with its program of justice for the poor held three workshops at different regions, Yogyakarta, Makassar and Tanggerang. The main objective of those workshops was to understand what people who those lived in rural and remote areas needed. Those workshop also tried to find the best solution to meet their need to justice.

The discussion on the role of paralegal became very important on those workshops. Sonja Litz (Senior Counsel of the World Bank) hoped that there would be two paralegals in each village in Indonesia.

Vice Minister of the Ministry of Law and Human Rights, Denny Indrayana stated that  he would check the composition of paralegals in the Law No. 16 of 2011. In fact, he agreed with the role of paralegal in providing legal aid.

Secretary of the Supreme Court Opened the Working Meeting of Badilag

Secretary of the Supreme Court, Nurhadi, SH, MH officially opened the working meeting held by the Directorate General of the Religious Courts, Tuesday night (21/2/2012),  in Hotel Garden Permata, Bandung.

Nurhadi stated that he was impressed by performance of Badilag. “I appreciate an amazing progress made by Religious Courts,” he said.

According to Nurhadi, Badilag had succeeded in budget utilization in which reached 97 percents. It was wonderful.

 

He suggested that the output and the outcome of programs be enhanced and be in accordance with the Blue Print of the Supreme Court 2010-2035.

Discourse on Family Court Establishment in Indonesia

Discourse on possibility of family court in Indonesia emerged in some discussions. Some people desired that a family court   with a special criminal jurisdiction to established. This court will enable woman and child get more access to justice.

LBH APIK held a workshop on this issue in Building of Ministry of Women Empowerment and Child Protection, Friday (17/2/2012). LBH APIK proposed some model of family court in which could be established in Indonesia. First, family court as special court belongs to the General Court for non-Muslim and family court as special court belongs to the Religious Court for Muslim.

This workshop invited two important speakers, the Director General of the Religious Courts, Wahyu Widiana and the Director General of the General Courts. Chief of High General Court of Jakarta, Ansyahrul represented the Director General of General Courts, Cicut Sutiarso who could not attend the workshop. Dian Rosita from LeIP also attended the workshop.

Wahyu Widiana stated that it was not wrong when people mentioned the Religious Courts as family court.

“It is the fact that almost 97 percents of cases handled by the Religious Courts are related to the family law matters”, he said.

He also explained that most of divorce cases were triggered by domestic violence both physical and psychological violence.

Wahyu Widiana Paid a Sudden Visit to RC of North Jakarta

Wahyu Widiana often pays a sudden visit to some Religious Courts. He does not aim to find any mistake but he wants to know the real condition.

Having arrived in the Religious Court of North Jakarta, Wahyu Widiana had pretended as justice seeker. He sat at waiting room and made short conversation with others.

“Are you waiting for a court trial?” Wahyu Widiana asked a woman of 40s years old. He also asked many question regarding down payment of case, schedule of trial, trial proceeding, etc.

He also observed a room used for service of legal aid post. He found two officers and he asked them on how to get a legal advice.

“You are from what Legal Aid Institute?” he asked the officers.

“We are from Sharia Legal Aid Institute, Sir,” the officers answered his question.
