The success of mediation in Sabah reaches 80% to 90%

The cases in the first level of Syar’iyah Court in Tawau reach 2,000 cases every year. All cases are settled by only one judge who serves as the chief of the court at the same time. Now, the judge is the Honorable Nurul Husni, a young authoritative pious man.    

In addition, according to Mr. Taufiq Bin Ali, a vice registrant in the High Syar’iyah Court of Kinabalu, there are only nine judges in all Syar’iyyah Court in Sabah. Meanwhile, all cases may reach up to 18,000 every year.  

In Sabah, there is the High Syar’iyyah Court city with only three judges which is located at Kinabalu and there are six first level of Syar’iyyah Court with only one judge per each.

DG of Badilag’s Public Lecture: Science, Skill, and Spirituality

In front of 97 judge candidates who were participating in education and training program, DG Badilag Wahyu Widiana delivered a public lecture on the subject of reformation on Religious Court. DG warned the importance of science, skill, and spirituality for judges. Public lecture that lasted about four hours was getting enthusiastic response from the participants.

According to Wahyu Widiana, science, skill, and spirituality, which are formulated in 3S is a requirement to engender judges as agents of change and realize the vision and mission of the Religious Court. “Science includes the understanding and control of legislation, customs, and related information. Skills include expertise in analyzing, writing, making decision and mastering in IT as well. Spirituality is moral and spirit.” stated DG.

Westlaw Journal in the Library of the Supreme Court

Library of the Indonesia’s Supreme Court begins to include Westlaw Journal, an international online law journal, as one of its sources as the library socialized the availability of the Journal on Thursday, 24 June 2010 in Jakarta.

Online Sales Manager Sweet & Maxwell Asia, Eric Pereira, as quoted by mahkamahagung.go.id, said Westlaw Journal enabled law practitioners, academicians and university students to find and learn cases and articles from 875 law journals worldwide. In addition, numerous documents from world’s law libraries along with the news can also be accessed online through this journal.

A number of Indonesian institutions have subscribed Westlaw journal, such as MK (Constitutional Court), KPPU (Commission for the Supervision of Business Competition), University of Indonesia, Padjajaran University, North Sumatra University, Pelita Harapan University, Trisakti University, and Atmajaya University.

Three Pillars for Service Improvement

Deputy Chief Justice for Religious Courts Affairs, Andi Syamsu Alam, highlights three aspects that must be put into practice by Indonesia’s Religious Courts to improve public service and the court’s image. Those are maximizing mediation, improving access to justice for the poor, and enhancing court transparency.

Deputy Chief Justice said all those three pillars should be made as ‘a weapon’ for the courts in executing the task to provide justice to the society. The Deputy Chief Justice delivered his statements on Wednesday (23/6/2010) on the program of technical guidance on court administration for Religious Courts all over East Kalimantan in Tarakan.

Sharia Students Asked to Watch Public Service of Religious Courts

Director General of Badilag Wahyu Widiana asked sharia faculty students all over Indonesia to closely watch public services provided by Indonesia’s religious courts and deliver the results of their observation to the DG for further improvement. According to Wahyu, society plays a significant role in helping courts to combat law mafia.

“Law mafia can only be eradicated by implementing judicial reform correctly and consistently supported by all elements of the society,” he said when delivering a speech as the keynote speaker of national seminar on ‘Combating Law Mafia’ which was held by Formasi (Forum Mahasiswa Syariah se Indonesia/Forum of Indonesia’s Sharia Students) on Thursday (19/6) in Surabaya.
