Online divorce application in Australia

DG of Badilag : Our legal system does not yet permit such application

People in Australia can file their divorce application online. This service, which was first introduced in August 2008 and has been recently implemented by the Family Law Courts (the Family Court and Federal Magistrates Court), is deemed beneficial for litigants who can efile (submit) their divorce applications through the Commonwealth Courts portal.

As reported by www.familycourt.gov.au, over 400 registered users have used this application to file divorce cases electronically since last September. According to Richard Foster, CEO of the Family Law Courts, this web-based application is aimed to improve access to justice, particularly for self represented litigants who comprise 85% of divorce applicants.

Nevertheless, applicants can not automatically have their cases finalized without having to come to the court. “It does not mean that people can get divorced online, this service simply provides people with an alternative way to file their applications, in addition to the traditional way by post or in person at a family law registry,” Richard Foster, who is also the Vice President of IACA International, said as quoted by familycourt.gov.au.

Chief Justice Hon. Harifin A. Tumpa urges all officials and officers in the Supreme Court and its subordinate courts to possess strong resolve and be willing to work hard to implement modernization process within all Indonesian courts.

Speaking before participants of Sharing Workshop Program: Building Spirit of Change – On the basis of Team and Organization Harmony, this morning (9/12) in Bandung, West Java, Harifin believes Indonesian courts will change to far more modern institutions. 

“Strong resolve and hard work are key factors for the success of the modernization process that the Supreme Court has been undertaking,” he said.

Leisha Lister, Executive Adviser to the CEO of the Family Court of Australia, said on Monday (7/12) that whatever Religious Courts wanted to do should be focused on what courts clients want. Everything should be for the clients needs and satisfaction.

The statement delivered by Leisha Lister before 25 participants of English discussion held at Badilag office. Leisha accompanied by Cate Sumner, Lead Adviser of IA-LDF, presented a paper entitled “Excellence in Client Service Delivery”.

Leisha gave a very detailed explanation of how client service is handled professionally by the Family Court of Australia which, like Indonesian Religious Courts, deals with family law matters. The participants coming from various regions of Indonesia looked enthusiastic to ask questions to both Leisha and Cate.

The success of 5 model District Courts should be further developed

Vice Chief Justice for Judicial Matters, Abdul Kadir Mappong, has said that In-ACCE (Indonesia Anticorruption and Commercial Court Enhancement), a project of USAid and the Supreme Court, has been successful in bringing Indonesian Anticorruption and Commercial Courts to more modern and professional courts.

Speaking before participants of the Conference of Learning Results of In-ACCE Projects in Denpasar, Bali, on Wednesday morning (2/12), Abdul Kadir Mappong said the beneficial project should be maintained and further developed not only in the five model district courts (Medan, Central Jakarta, Semarang, Surabaya and Makassar) but also in other district courts as well as religious courts.

Jinayat Verdicts Publication Really Needed

Publication on Jinayat Verdicts by Religious Court of Nangroe Aceh Darussalam Province via the internet has gained a positive response from academicians. The publication is really helpful for academicians to facilitate the study of Islamic law.

“The access to get reference of the study of Islamic law becomes easy due to the publication”, says Jainal Arifin, the Secretary General of the Association of Indonesian Scientist and Shari’a Scholar (HISSI), Monday (30/11).

According to Jainal, Jinayat or what so called Islamic Law of crime is one of the specific competences belongs to the Religious Court of Nangroe Aceh Darussalam as approved by the Law of Religious Court. Although the court only handles particular crimes, this competence has attracted so many attentions.
