Various Issues of Prodeo Cases Will Be Resolved

The Supreme Court is intensifying the legal aid program, especially in the discharge of civil case cost or usually called as prodeo cases. The Supreme Court is also trying to provide the best service to the people who request for birth certificate order.

The enactment of the Circular Letter No. 6 of 2012 on the Guidelines for Birth Certificate Order Exceeded One Year Collectively has increased the amount of applicants for birth certificate order. Nevertheless, what has been done by the Supreme Court was not fully run well.

Since the enactment of the Law No. 16 of 2011 on the Legal Aid, the budget of legal aid was not under the management of Supreme Court anymore, but has been diverted to the Ministry of Law and Human Right. On the other hand, the Supreme Court expects that the people who request for birth certificate order do not pay some charges. This need to be solved by involving related agencies.

Again, JC presented ‘special gift’ to the Religious Courts

Once again, the Indonesian Judicial Commission (JC) conveyed a good appreciation to the religious courts. This time, JC presented two special gifts at once.

The first was a special interview with former Director General of Badilag, Wahyu Widiana published on their rubric ‘Lebih Dekat’ on the page 24-27 entitled ‘Do not underestimate Religious courts anymore’ on its bulletin, edition for September-October 2012.

By quoting the book of Courting Reform: Indonesia’s Islamic Courts and Justice for the Poor, the editorial team of JC noted that religious courts has brought at least three principal changes and now stand as a model for judicial reform in Indonesia.

An Important Change About Mediation in the Religious Courts

There is an important change related to the divorce mediation in the religious courts. All this time, the success of mediation is solely measured by reconciliation of the disputed spouses. In the future, mediation will be considered success when they get an agreement about divorce consequences, even they can not be reconciled.

“Firstly, the success of mediation means the spouses do not divorce. But there was a shift in the recent national working meeting. Later Book II will change too.” The secretary of Directorate General of Badilag, Drs. H. Farid Ismail, SH., MH said when opening the family mediation workshop in Nusa Dua, Bali (11/21/2012). The workshop was conducted in cooperation with the Family Court of Australia and facilitated by Australia—Indnesia Partnership for Justice (AIPJ).

Badilag-Family Court of Australia Again Hold A Mediation Workshop

For the third time in this year, Directorate General of Badilag in cooperation with the Family Court of Australia held a mediation workshop. The current workshop facilitated by Australia-Indonesia Partnership for Justice (AIPJ) is conducted for three days, November 21st –23rd, 2012 in Nusa Dua, Bali.

Thirty judges become the participant of the workshop. The total number is the same as it was conducted on March and December this year.

Pioneering the Innovation and Development of SIADPA, Malang Regency RC Got an Inscription and an Award Certificate

The Secretary of Directorate General of Badilag, Drs. H. Farid Ismail, SH., MH conferred an inscription and an award certificate to Malang Regency Religious Court on Saturday (11/09/2012). The inscription and award certificate were given due to its pioneering in innovating and developing SIADPA which has been the backbone of the Religious Court apparatus to accomplish the case administration.

The inscription and award certificate were handed by the Secretary to the Chief of Surabaya High Religious Court, Drs. H. Rum Nessa, SH., M.Hum., and then handed again to Kepanjen Religious Court and accepted by the Deputy Chief of Kepanjen Religious Court, Drs. H. Suhardi, SH., MH.
