Sudan, the Right Place to Study Sharia Economy Law

A comparative study team from the Supreme Court arrived at Jakarta (20/10) after two weeks studying sharia economy law in Sudan. DG of Badilag, Wahyu Widiana, welcomed the delegation consisting of seven religious courts judges and headed by Nasich Salam, a graduate from Sudan University. When meeting with the DJ, the team also submitted a 200-page written report.

“We very much thank the DG of Badilag, along with all the leadership of the DG, who have fully supported us and given us the trust and facilities so that we could run the comparative study smoothly,” Nasich Salam said.

He further explained that during their study in Sudan (5 – 20 October 2010), the team learnt many things related to sharia economy law, both procedural and substantial laws. In addition, the team studied the law system applied in this Islamic country. .

Courts Urged to Implement Quick Wins and Enhance Public Service

All elements of the Indonesian judiciary are urged to implement important points resulted from the Supreme Court’s National Working Meeting (Rakernas) that was held 11-14 October 2010 in Balikpapan, East Kalimantan.

“All elements in the Supreme Court including DG of Badilag (Religious Courts Body) and all Indonesian religious courts should take immediate actions to follow up the results of Rakernas,” DG of Badilag, Wahyu Widiana, said when chairing a meeting on the socialization of Rakernas, Tuesday morning (19/10) at Badilag’s meeting room.

“We (DG Badilag) also have an obligation to oversee bureaucracy reforms in the religious courts to run well. That’s not an easy task to do,” Wahyu added. .

Spirit of Change towards the Great Judiciary

Chief Justice, the Hon Harifin A. Tumpa, officially opened the 2010 Supreme Court’s National Working Meeting (Rakernas/Rapat Kerja Nasional) today (Monday, 11/10) in Balikpapan, East Kalimantan. The meeting which is held annually will take place until 14 October 2010.

The Rakernas took the theme “Strengthen the foundations towards the Indonesian Great Judiciary with the Spirit of Change”. Chief Justice said the theme was intentionally taken due to the need of spirit to change toward the better.

“We need to change to be advanced. Indonesia experiences changes in all areas. Each component of the nation, including judicial officers, must change their mindset,” Chief Justice said.

Following up the issuance of Supreme Court’s Cicular Letter (SEMA) No. 10/2010 on the Guidelines of legal Aid Provisions, Indonesian Supreme Court, facilitated by IAJPT (Indonesia Australia Justice Partnership - Transition), held a workshop on operational development and cooperation patterns of Posbakum (Legal Aid Post at Court), in Bandung from 1 – 3 October 2010.

Deputy Chief Justice for General Civil Cases, Atja Sondjaja, officially opened the workshop which was attended by around 40 participants from Supreme Court and its lower courts, Bappenas (National Development Planning agency), Ministry of Finance, Advocate Organization, NGO, and Civil Society Organizations.

Religious Court Judges Must be tough and able to Solve Sharia Economy Disputes

After conducting long discussion with The Sudan Embassy and The Supreme Court of Sudan, the arrangement on Islamic Economy training was finally approved. The Directorate General of Religious Body delegated 7 judges and judge candidates to participate in the program of Islamic economy training in Sudan from 5-20 October 2010. Sudan Government vouches accommodation and living allowance for all participants.

Those seven chosen judges as well as judge candidates are H. Nasich Salam, Lc., LLM. (Religious Court of Yogyakarta), H. Abdul Halim Muhammad Sholeh, Lc., M.Ec. (Religious Court of North Jakarta), H. Armansyah, Lc. (Religious Court of Rengat), Mahrus, Lc. (Religious Court of Sanggau), Mohammad Adam, S.HI (Religious Court of Bitung), H. Abdul Majid, S.HI, M.H (Religious Court of Giri Menang), dan Ahmad Zaenal Fanani, S.HI., M.Si (Religious Court of Martapura).

Deputy Chief Justice, Drs. H. Andi Syamsu Alam, SH., MH., during the briefing in front of the delegations in Cemara Hotel Jakarta (1/10) asserted that the priority of the DG recently is improving human resources. He also stressed that one of religious court jurisdiction is sharia economy dispute. The judges must be able to examine and administer justice in this area with the reliable judgment.
