Sudan judges visit Supreme Court

Supreme Court Chief Justice, Harifin A. Tumpa, received a courtessy call from Sudanese Supreme Court delegation on Monday (22/2). The delegation consists of 2 high court judges, 6 judges from first instance courts and 2 representatives from the  Department of International Development, the United Kingdom that sponsors this visit.

Chief Justice, accompanied by Vice Chief Justice, Abdul Kadir Mappong, Vice Coordinator for reform Team, Prof. Takdir Rahmadi, Justice Prof. Abdul Gani Abdullah, warmly welcomed the delegation that arrived in Indonesia on Saturday (20/2)

Risky, Formalizing Sharia Law into Positive Law

Prof. Bagir Manan, former Supreme Court Chief Justice, said there were a number of risks to formalize sharia law into positive law. First, it will ideologically undermine sharia law since the choice of law will further give precedence to positive law over sharia. In addition, there will be secularization (not secularism) of sharia law, i.e. marriage law.

Prof. Bagir asserted those statements when presenting his paper at the national seminar on Religious Courts’ Substantive Law in Jakarta (19/2).

Judges must uphold procedural law to reveal procedural justice and enforce substantive law to secure substantive justice, says Supreme Court Chief Justice.

“We must not prioritize one over the other. Procedural law is as important as substantive law. If we ignore the formal law, then injustice will emerge. That applies likewise,” Chief Justice Harifin A. Tumpa said Friday (19/2) when delivering keynote speech at National Seminar on Religious Courts’ Substantive Law, in Jakarta.

Supreme Court selects 27 ad hoc corruption judges

The Supreme Court has selected 27 ad hoc judges that will hear corruption cases in seven provinces across the country.

Spokesman for the Supreme Court Hatta Ali, said Wednesday that 19 judges would serve at the district level in Jakarta, Bandung, Semarang, Medan, Palembang, Samarinda and Makassar and four from each region would hear appeal cases at the provincial high court and the Supreme Court.

“The number of judges is too small compared to the number of graft cases they will hear. We only managed to select 27 judges due to a lack of human resources,” Hatta told Antara state news agency.

Director General of Badilag, Wahyu Widiana, said Religious Courts should pay greater attention to public complaints to enhance the quality of public services. Rate of justice seekers satisfaction is also needed to measure so as to evaluate the courts shortcomings in providing the services.

“The improvement of Human Resources is a must to guarantee that the services meet public expectation,” he added. Wahyu made those statements when officially opening Regional Working Meeting of High Religious Court (PTA) of Jayapura in Manokwari, West Papua on February 11, 2010. Governor of West Papua also attended the meeting.
