Islamic Law Reform and Court Modernization Need to Be Upheld

Chief of the Supreme Court’s Chamber of the Religious Courts, Andi Syamsu Alam, really hopes that Indonesian religious courts judges play a role in reforming Islamic law in Indonesia.

“It is us, Indonesians, who can reform Islamic law, not Arabians. Egypt, Syiria and other Arabic countries are busy at war,” Andi Syamsu Alam said on Thursday (9/11/2013) when attending a reunion ceremony of judges from 1993 badge in Bogor West Java.

Chief Justice Discusses Judicial Reform in USA

Chief Justice Hatta Ali delivered a general speech in front of the United States Indonesia Society, Tuesday at Cosmo Club, Washington DC (5/11/2013). He discussed on Indonesian judicial reform.

The discussion was attended by around 100 participants including lawyers, delegates from Ministry of Foreign Affairs of USA, World Bank, Trade Chamber of USA, USAID, students, and American observers.

David Merrill, the president of USINDO served as moderator of the discussion. He had an experience as Mission Director in Indonesia for six years.

Some hot issues were addressed in this program such as transparency, access to justice, Supreme Court’s strategy on judicial reform, general election, human rights and protection for women and marginalized.

Chief Justice was facilitated by Change for Justice (C4J) for his visit to America. During the visit, Indonesian delegate learn about public service, information access, information technology, judicial management, and data processing.

Cooperation with Ministry of Religion and Civil Registration Office, Badilag Ready to Employ Integrated Service

Badilag, Ministry of Religion and Civil Registration Office will soon realize an integrated service for marriage legalization, marriage registration and registration of birth certificates. This service is provided especially for poor people to obtain legal identities.

The three institutions have decided four regions as trial areas and developed a guideline draft for the implementation of the service.

The above agreement was reached during a coordination meeting attended by officials of Badilag (Religious Courts) and officials from the Ministry of Religion at Badilag’s office on Monday (4/11/2013).

Non-Muslims Allowed to Work as Religious Court Officers

Officers and staff members working in Indonesia’s Religious Courts are not limited to Muslims only. Non-Muslims are also welcome to work in this court.

Chief of the Supreme Court’s Chamber of the Religious Courts, Dr. H. Andi Syamsu Alam, confirmed the above statements when leading a coordination meeting between Badilag dan Chief Judges of High Religious Courts all over Indonesia in Bogor last Thursday (31/10/2013).

“Yes, (Non-Muslims) can. But not for judicial technical officers/staff members,” Andi Syamsu Alam said. Judicial technical officers are judges and registry officers such as registrars/substitute registrars and bailiffs/substitute bailiffs.

The fact shows that in several religious courts in Bali, East Nusa Tenggara and Papua, non-Muslims are already working for the religious courts.

Badilag Launches SIADPTA Plus

Recently, the Directorate General of the Religious Courts (Badilag) launched SIADPTA Plus, an application program for case management. Vice Chief Justice for Non Judicial Affairs Ahmad Kamil launched the program, in Bogor (31/10/2013).

Chief Chamber of Religious Court Affairs Dr. H. Andi Syamsu Alam, S.H., M.H and the Director General of the Religious Courts Drs. H. Purwosusilo, S.H., M.H also attended the launching.

Ahmad Kamil said that he was happy with amazing creativity made by religious courts. It is a sophisticated application program.


He mentioned that delegates from America recently visited Indonesian Supreme Court. During the visit, Chief Justice Hatta Ali asked appeal courts to develop case management application program.

Religious Courts have been implementing case management application program called SIADPA. It is for first instance courts. In appeal courts, SIADPTA has been developed and implemented in all appeal religious courts since 2009. It is now redesigned with more sophisticated features. Better security system is applied to this new program.
